What is Miya’s Law?

Miya’s Law is a tenant safety law named in honor of Miya Cecilia Marcano, a 19-year-old college student whose life was tragically taken in September 2021 when a maintenance worker abused unchecked access to her apartment. 

The law was created to address the failures that led to Miya’s death — ensuring that apartment communities across the United States adopt stronger, common-sense safety measures to protect residents.

Core Protections of Miya’s Law

Strengthening Tenant Safety Nationwide

Miya’s Law creates safer, more accountable housing environments by requiring stronger background checks, tighter key access control, and better tenant communication.

Background Checks

All apartment employees with access to residential units must pass a mandatory criminal background screening. This helps prevent abuse of access and builds trust between tenants and property staff.

Key Control

Strict procedures ensure that master keys are securely stored, tracked, and used only by authorized personnel — creating full accountability for every key issued.

Tenant Notice

Property managers must provide at least 24 hours’ written notice before entering a tenant’s unit, except during emergencies. This guarantees residents’ privacy and safety.

Encourages consistent, enforceable safety measures across all apartment communities — protecting students, seniors, and vulnerable residents nationwide.

Passed in Florida (2022), Virginia (2023), and Nevada (2025), Miya’s Law continues to gain bipartisan support with a goal of nationwide implementation.
